What is a sensible basis for copyright?
John Perry Barlow wrote about it fifteen years ago:

Barlow is not just talking through his hat. He and the other members of The Grateful Dead got quite rich doing exactly what he says. That gives his observations a considerable weight in terms of what works, and why, in the field of IP.
